What to do if your church is faced with a lawsuit or other legal action:

Legal action against a Foursquare church or school is usually communicated in one of the following ways:

• A threat, verbal or written, of some type of legal action.
• A Notice of Representation from an attorney for a person/organization taking some type of action against your church and/or staff member.
• A Summons and Complaint notifying you of a pending lawsuit.
• Any other communication from a court advising you of legal action against your church, school, etc.

If you receive any of the types of communication listed above it is imperative that you contact your District Supervisor and the Foursquare Corporate Legal Counsel immediately. The phone number for the Foursquare Corporate Legal Counsel is: (213) 989-4210.

Usually, there will be a very limited amount of time in which to respond to the communications listed above. If the reponse is not made within the time frame allowed the outcome of the case could be adversely affected.

Once the matter has been referred to the Foursquare Corporate Legal Counsel, refer all inquiries regarding the matter from other attorneys, other insurance personnel, interested parties and the press to the Foursquare Corporate Legal Counsel. In certain cases, the Foursquare Corporate legal Counsel and/or the insurance carriers involved will appoint a law firm in your area to work with you in resolving the matter. You will be advised if this is the case and asked to extend your full and complete cooperation. It is important that no action be taken on your part unless requested by the Foursquare Corporate Legal Counsel or other designated legal representative.

Bonds

Periodically, Surety or Performance Bonds are required for construction projects, site improvements, landscaping projects and other issues. The Foursquare Insurance Department can assist you in obatining a bond for your church. The amount of the bond will vary depending upon the exact type of bond being requested, the company issuing it and the location involved.

The following data is required for the issuance of a bond:

• The original agreement with the entity requesting the bond (faxes and copies are not acceptable).
• The required amount of the bond with supporting documentation.
• The Engineer's cost break-down substantiating the bond amount, if applicable.
• Other pertinent data as required.
• The local church must receive and provide the appropriate bond forms from the entity requesting the bond. In most cases, this would be a city or county governing authority.

The entire procedure for the issuance of a Surety or Performance Bond takes approximately three (3) weeks.
